Terms of Use Thuringian Agency For Skilled Worker Recruitment

1. Scope of application

The following conditions apply to the entire range of services offered by ThAFF. ThAFF provides services exclusively under these terms of use. Deviating, conflicting or supplementary conditions shall not become part of the contract. For reasons of better readability, the simultaneous use of the language forms masculine, feminine and diverse (m/f/d) is dispensed with. All personal designations apply equally to all genders within the meaning of the generic masculine.

2. Subject

2.1 The subject is, on the one hand, the information and advice for skilled workers – on relevant facts regarding working and living in the Free State. On the other hand, the subject of the ThAFF is to sensitize Thuringian employers and institutions to the upcoming demographic challenges, to draw attention to their effects and new developments in human resources management.

2.2 The use of ThAFF services by personnel service providers (personnel consultancies, personnel placement agencies, personnel leasing, etc.) is generally excluded.

2.3 ThAFF is entitled to use third parties (cooperation partners) in the performance of its tasks.

2.4 There is no legal entitlement to use the ThAFF service. ThAFF is entitled to discontinue or restrict its service offering at any time; no claims for damages arise for the user as a result.

3. Services of ThAFF

3.1 To fulfill the tasks mentioned in Section 2, ThAFF will generally provide the following services:

Towards (potential) workers and skilled professionals:

  • Job exchange that can showcase job and Career opportunities in the Free State
  • Applicant exchange for posting an anonymized profile
  • Consultations, e.g., in the context of individual meetings, workshops, and lectures
  • Conducting events and lectures on various topics related to working and living in Thuringia
  • Organization of job fairs (analog and digital)
  • Application folder check
  • Social media offers
  • Establishment and promotion of Contacten with relevant actors
  • Provision of current information about the training, study, care, and work location Thuringia
  • Referral counseling
  • Provision of a service hotline
  • Support with questions and topics regarding the compatibility of work and family
  • First point of contact for people with a migration background

For employers with registered office or branch in Thuringia:

  • General address to skilled workers who (want to) work and live in Thuringia
  • Possibility of publishing job profiles in the Thuringian Job And Applicant Exchange (exclusively with reference to Thuringia)
  • Independent management of your own job profiles and contacting applicants, after login and registration
  • On-demand support for micro and small enterprises (up to max. 49 employees) in publishing job profiles
  • Raising awareness on various topics related to the retention and recruitment of skilled workers
  • Offers for workshops / information events on selected topics of securing skilled workers
  • Establishing contacts with other relevant actors and cooperation partners (referral counseling)
  • Networking and strategic partnerships
  • Submission of offers to participate in ThAFF-organized skilled worker events/Trade Fairs as well as external events/Trade Fairs (analog and digital)
  • Support with questions and topics regarding a family-conscious personnel policy
  • Contact point for Thuringian employers who want to hire people from abroad

3.2 The number of job postings published in the ThAFF job board must not exceed the number of job postings on the advertising employer's own company website and is limited to a maximum of 15 new or updated job postings per week.

3.3 The Thuringian Agency For Skilled Worker Recruitment reserves the right to periodically present an employer of its choice by agreement, without any legal entitlement arising from this. Such employer presentations may take place in various media. ThAFF is also entitled to use customer data and data arising in the course of the business relationship for trend analyses and overviews and to publish them in anonymized form. The processing of company data is subject to data protection regulations.

3.4 Access to applicant data by employers and vice versa is only permitted after prior registration / login and use of the created login password. Passing on the login data (username/password) to third parties is not permitted.

3.5 Creating a false identity, misrepresenting one's own identity, creating a profile of a natural person for someone other than oneself, as well as using another person's profile or attempting to do so, like any other misuse of the respective portal, will result in the blocking of the relevant profile and the assertion of claims for damages.

3.6 ThAFF is entitled to adjust the design and presentation forms of its operated internet platforms at its own discretion at any time. ThAFF is entitled to change, supplement, or deactivate individual functionalities and content of its services, as long as this does not impair essential performance obligations of ThAFF towards the customer.

3.7 The provision of ThAFF services is free of charge for both interested parties and employers.

3.8 ThAFF does not assume any costs of interested parties in connection with attending a consultation, e.g. for travel and/or accommodation. Expenses for this must be borne by the interested party themselves. Any claims against third parties in this regard remain unaffected. Furthermore, ThAFF does not assume any costs incurred by the employer in the context of using ThAFF's services.

3.9 The service is provided from the ThAFF's location.

4. Validity period

4.1 These terms of use take effect from the time of initial contact.

4.2 In the event of a lack of cooperation, ThAFF may immediately cease its service to the respective other party.

5. Service Period

The service hours of ThAFF are:

Monday – Thursday 09:00 AM – 05:00 PM
Friday and before public holidays 09:00 – 15:00

Further appointments by arrangement.

6. Obligations to Cooperate

The other party (employer or interested parties) must ensure that the ThAFF is provided with all documents necessary for the performance of its activities in a timely manner, that it is given all information, and that it is informed of all relevant processes and circumstances. This also applies in particular to documents, processes, and circumstances that only become known during the ThAFF's activities.

7. Liability and Statute of Limitations

7.1 Liability of ThAFF, its legal representatives and vicarious agents for damages that do not result from injury to life, body or health is excluded, except for liability for intent and gross negligence.

7.2 ThAFF is not liable for the success of its consulting activities, the content and accuracy of the information provided by employers and/or interested parties when entering their data in the ThAFF job or applicant exchange, nor for compliance with deadlines.

7.3 ThAFF also does not assume liability for a specific success in establishing a Contact or for damages caused by an employer or interested party or subsequent employees.

7.4 ThAFF assumes no responsibility for the redistribution of freely accessible content on our website (incl. job offers) by third parties.

8. Duty of confidentiality and data protection

8.1 ThAFF is obliged to report statistical data on employers and interested parties to the Free State of Thuringia. Otherwise, ThAFF only collects, processes, or uses data to the extent necessary for the activities of ThAFF described herein. No commercial use of the data takes place. Users themselves are responsible for the personal data they upload. Personal data and documents (e.g., CV, certificates, etc.) are only visible to registered employers in the event of an application for specific positions directly via the job and applicant exchange. In order to provide its services, ThAFF relies on the disclosure of personal data (e.g., certificates and CVs). Users are informed in accordance with the <a href="/datenschutz/" title="Datenschutzerklärung">privacy policy</a> that ThAFF stores the personal data transmitted to it within the framework of the contractual relationship (e.g., application documents) in machine-readable form and processes them mechanically to provide its service. 8.2 By accepting ThAFF's offer, both parties agree to comply with all applicable data protection laws.

8.3 When engaging third parties, ThAFF must ensure their obligation to maintain confidentiality.

8.4 The documents and information provided by ThAFF to an employer are intended exclusively for that employer. The employer is not entitled to pass on documents and information – neither in original nor in copy – to third parties. The right to assert any resulting damages is reserved.

8.5 The interested parties and the employers are obliged to exercise the utmost care when using passwords, user names or other security devices provided in connection with the ThAFF offers and to take any measures that ensure the confidential and secure handling of the data and prevent its disclosure to third parties. The interested parties or the employer will be held responsible for the use of the passwords or user names by third parties, unless it can be conclusively demonstrated that access to such data was not caused by themselves and that the reasons for this could not be influenced. ThAFF must be informed immediately about any possible or already known unauthorized use of the access data. In the event of a violation of one or more of the obligations mentioned in these terms of use, ThAFF is entitled to terminate its service immediately.

8.6 The interested parties and employers provide the documents in digital form.

9. Final provisions

9.1 Amendments and additions to these terms of use require written form to be effective.

9.2 If individual provisions of these Terms of Use are or become invalid, the validity of the remaining provisions shall not be affected. In such a case, the parties shall replace the invalid provision with another that comes as close as possible to the economic purpose of the omitted regulation in a reliable manner.

9.3 Information pursuant to Section 36 (1) of the German Consumer Dispute Resolution Act (VSBG): There is no legal or other obligation of LEG Thüringen to participate in out-of-court dispute resolution proceedings before a private consumer arbitration board recognized under the VSBG or before a public consumer arbitration board established under the VSBG. LEG Thüringen does not participate in dispute resolution proceedings before a consumer arbitration board.

9.4 The law of the Federal Republic of Germany shall apply.

9.5 The place of jurisdiction is Erfurt.
